1) About These Terms

These Terms govern your access to and use of DateFlag AI ("DateFlag," "we," "our," "us") and any related services or websites (the "Service"). By using the Service, you agree to these Terms and our Privacy Policy.

2) Eligibility

  • The Service is for adults 18+ only.
  • You represent that you are legally able to enter a binding contract.
  • You agree to provide accurate information and maintain one account per person.

3) Accounts and Security

  • You are responsible for your account and all activity under it.
  • Keep your credentials confidential.
  • Notify us immediately of any unauthorized use.

4) Subscriptions and Payments

  • Some features may require a paid subscription that auto-renews unless canceled.
  • Subscriptions are managed via RevenueCat and processed by app stores or payment processors (e.g., Apple App Store / Google Play). Their terms and refund policies apply.
  • Trials, pricing, and material changes will be disclosed with reasonable notice where required.
  • Prices may exclude applicable taxes.

5) User Content and Permissions

  • You own the content you upload (e.g., screenshots, text).
  • You grant DateFlag a non-exclusive, worldwide, royalty-free license to host, process, analyze, and display your content as needed to operate and improve the Service.
  • You are responsible for having necessary rights and consents to upload any third-party content appearing in your uploads.
  • Do not upload content that violates privacy, intellectual property, or other rights, or that contains sensitive personal data without consent.

6) What the Service Is (and Isn’t)

  • The Service provides AI-generated analysis of dating conversations for informational purposes only.
  • It is not a substitute for professional advice (legal, medical, psychological, safety, or otherwise).
  • We do not guarantee accuracy, outcomes, matches, safety, or the suitability of any suggestions.

Safety notice: If your safety is at risk or you are in immediate danger, contact local authorities or emergency services right away. The Service is not intended for emergencies.

7) Acceptable Use

  • Do not use the Service for unlawful, harmful, or deceptive purposes.
  • Do not upload illegal, harassing, hateful, discriminatory, or sexually exploitative content, or any content depicting minors.
  • Do not upload malware or attempt to bypass security.
  • Do not scrape, reverse engineer, or interfere with the Service.
  • Do not impersonate others or misrepresent your identity.

8) Privacy and Data

Our data practices are described in the Privacy Policy.

9) Third-Party Services

We use providers such as Supabase (database/auth) and RevenueCat (subscriptions). Your use of app stores and payment processors is subject to their terms and policies. We are not responsible for third-party services.

10) Intellectual Property

DateFlag, our trademarks, software, and content are owned by us or our licensors and protected by law. Except for the limited rights granted here, no rights are transferred to you.

11) Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including accuracy, merchantability, fitness for a particular purpose, or non-infringement. We do not warrant uninterrupted or error-free operation.

12) Limitation of Liability

To the maximum extent permitted by law, DateFlag and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business interruption. Our aggregate liability for all claims related to the Service will not exceed the amounts you paid to us for the Service in the 12 months before the event giving rise to the liability.

13) Indemnification

You will defend, indemnify, and hold harmless DateFlag and its officers, employees, and partners from claims, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, or your breach of these Terms.

14) Service Changes and Availability

We may change, suspend, or discontinue features or the Service at any time. We are not liable for any modification, suspension, or discontinuation.

15) Termination

We may suspend or terminate your access immediately if you violate these Terms or if required by law. You may stop using the Service at any time and request account deletion per the Privacy Policy.

16) Governing Law and Disputes

These Terms are governed by the laws of Ireland. You agree to the exclusive jurisdiction and venue of the courts located in Ireland. Consult counsel if you wish to include arbitration and a class-action waiver.

17) Changes to These Terms

We may update these Terms. Material changes will be communicated (e.g., in-app or email). Continued use after changes means you accept the updated Terms.
